TERMS


BOOKINGS

For all sessions; a non-fundable session deposit is required to secure and reserve the date for your session and serves as a cancellation or reservation fee. The fee is credited towards a future session upon the photographer's approval. All remaining balances are due at the time of the session.


CANCELLATIONS

Client forefeits their session deposit paid to book the session. As previously stated, the fee can be credited towards a future session if the client reschedules the appointment by calling 72 hours prior to the date of session and re-booking at an agreeable date and time.



If Nandi or any other KING NANDI & CO. representative cannot perform the undertaking due to fire or other casualties, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or other media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.


PAYMENT

All sessions and packages (plus taxes) can be paid via EFT, instant cash. If a client pays by EFT, a Proof of Payment must sent via email.



Due to the nature of our business, a 50% deposit is required in order to secure your booking. The rest of the obligation needs to be met by or on the day of the shoot.

COPYRIGHT


Acceptance of Terms

By accepting a quotation, paying a deposit, or engaging King Nandi & Co., the Client agrees that all agreements — whether written or verbal — are governed by these Terms and Conditions. Engagement of services constitutes full acceptance of these terms.



Intellectual Property & Website Usage

All content, images, videos, creative concepts, frameworks, strategies, layouts, designs, and materials produced or displayed by King Nandi & Co. are protected under copyright and intellectual property laws.


Strict Prohibition

Copying, screenshotting, reproducing, sharing, distributing, editing, recreating, reverse-engineering, or using our work — whether from our website, social media platforms, presentations, proposals, mood boards, PDFs, or client galleries — without prior written consent is strictly prohibited.


Any unauthorised use, including screenshots or duplication of creative concepts, will result in:

• Immediate legal action

• Claims for damages

• Recovery of legal costs

• Financial penalties in accordance with South African intellectual property law


We actively monitor and protect our creative assets.



Subcontractors & Non-Circumvention

King Nandi & Co. may engage stylists, editors, assistants, or other specialists.


Clients may not approach, hire, or communicate directly with subcontractors without written consent. Any attempt to bypass King Nandi & Co. constitutes a material breach of contract.



Copyright & Usage Rights

Ownership

King Nandi & Co. retains full copyright over all work produced.


Usage

Clients are granted usage rights strictly as outlined in their quotation or agreement. Any additional or commercial usage beyond scope requires written approval and may incur additional fees.


Unauthorised Usage

Use of images, videos, or creative frameworks outside agreed terms — including replication of campaign concepts — will result in legal action.


Promotional Rights

King Nandi & Co. reserves the right to use produced content for portfolio, editorial, promotional, and marketing purposes unless agreed otherwise in writing.



Alterations & Integrity

Images and videos may not be altered, filtered, edited, cropped, recoloured, or manipulated without prior written consent. This includes AI modification or repurposing content into derivative works.



Rejection & Kill Fees

Creative work is subjective. The Client acknowledges that rejection based solely on stylistic preference does not negate payment obligations.


If a brief is met and work is rejected, full payment remains due.


Non-publication does not exempt payment.



Governing Law

This agreement is governed by the laws of the Republic of South Africa. Disputes shall be resolved within South African courts unless otherwise agreed in writing for international engagements.



Variation

No amendment to these Terms and Conditions is valid unless agreed to in writing and signed by both parties.

When I should choose a mini session instead of full session?

How do I get started with my shoot?

A. We help you prepare your shoot day. We finalise via email or call to discuss the requirements of your shoot.


Where are you based and do you travel?

A. We are based in Johannesburg and operating countrywide.


When will we get our photos?

A. You will receive an online gallery link or WeTransfer link with your photos within maximum 3 weeks (sometimes less depending on the season). You can download all the photos from the gallery but also share them, choose your favourites, and also order prints!


How many pictures will we receive?

A. Depending on the offering you choose and time we photograph, we provide JPEG/PNG images to you.
